By downloading, installing, or using the Fake or Real mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Fake or Real provides AI-powered product authenticity verification services. The App analyzes images of products using multiple artificial intelligence models to provide an assessment of whether a product appears to be authentic or counterfeit.

3. Important Disclaimers

3.1 Not a Guarantee

The App provides opinions and assessments based on AI analysis, not definitive authentication. Results should be used as one factor in your decision-making process, not as the sole basis for determining product authenticity.

3.2 No Liability for Decisions

We are not responsible for any decisions you make based on the App's analysis, including but not limited to:

• Purchase or sale of products
• Returns or refunds
• Legal actions or disputes
• Financial losses

3.3 Accuracy Limitations

While we strive for accuracy, AI analysis has limitations. Results may be affected by:

• Image quality and lighting
• Camera angle and focus
• Product condition and wear
• Sophistication of counterfeits
• AI model limitations and biases

4. User Responsibilities

4.1 Acceptable Use

You agree to:

• Use the App only for lawful purposes
• Provide clear, unaltered images of products for analysis
• Not use the App to verify products you know to be counterfeit for resale purposes
• Not attempt to reverse engineer or manipulate the App's AI analysis

4.2 Prohibited Activities

You may not:

• Use the App to facilitate the sale of counterfeit goods
• Share or resell scan credits to other users
• Attempt to circumvent payment or credit systems
• Upload inappropriate, illegal, or harmful content

5. In-App Purchases

5.1 Scan Credits

• Scan credits are consumable in-app purchases processed through the Apple App Store
• Credits are deducted only when analysis is successfully completed
• Credits do not expire and remain in your account until used
• Credits are non-transferable and have no cash value

5.2 Refunds

Refund requests for in-app purchases must be made through Apple's App Store, as we do not process refunds directly. Refunds are subject to Apple's refund policy.

6. Intellectual Property

The App, including its design, code, algorithms, and content, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAKE OR REAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

8. Indemnification

You agree to indemnify and hold harmless Fake or Real from any claims, damages, liabilities, and expenses arising from your use of the App or violation of these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
